4. Agency Relationship
4.1 Role as Agent
For all international tour wholesalers and foreign travel companies (“the Principal”), Pacific Destinations Ltd acts solely as the authorised agent of the Principal. The Principal authorises PD, as agent, to arrange and confirm accommodation, transport, activities, and related services on behalf of the Principal.
4.2 Contracting Parties
When PD confirms a booking with a New Zealand service provider, the contract is between the service provider and the Principal. PD acts only as the authorised agent. Rights under the contract are enforceable by the Principal.
4.3 Payment to Suppliers
Although the Principal is liable for payment, PD will pay New Zealand service providers on behalf of the Principal. The Principal must reimburse PDL for all such payments.
4.4 Agency Fee
In consideration for acting as agent, the Principal agrees that PD may retain an agency fee equal to the difference between the price charged to its clients and the amount PD negotiates with New Zealand suppliers.
4.5 Relationship with Suppliers
PD will notify New Zealand suppliers that it is acting as authorised agent for non-resident Principals and that contracts are with those Principals. PD will pay suppliers on behalf of the Principal.
5. Confidential Tariff
All prices are net and inclusive of applicable local taxes. Information was correct at publication and may change. PDL reserves the right to adjust prices, itineraries, and content due to circumstances beyond its control.
6. Quotations & Reservations
All prices quoted are net in the stated currency and valid only for the dates specified. Travel date changes require requoting. Group quotations depend on minimum numbers. PD aims to confirm all requests within 48 hours.
7. Facilitation Services
Quoted prices include PD’s services in facilitating and arranging the tour on behalf of the Principal.
8. Deposits / Prepayment
During peak seasons or special events, deposits or prepayments may be required by suppliers. You will be advised when applicable.
9. Full Payment
A final invoice is issued 35 days prior to arrival. Full payment is due no later than 28 days prior. Late payment may result in cancellation. Payment must be made to the correct account, noted on all invoices.
10. Group Rooming Lists
Hotels require preliminary rooming lists 60 days prior and final lists 35 days prior. Failure to meet deadlines may result in cancellation or fees.
11. Final Documentation
Groups are met personally by PD staff in Auckland or via representatives elsewhere. FIT documentation is provided by the first service provider.
12. Amendments
Amendments requiring re-costing may incur fees. Changes within 35 days of arrival may incur supplier charges.
13. Cancellations
Cancellations must be received and acknowledged in writing. Cancellations more than 35 days prior may forfeit deposits; cancellations within 35 days typically incur fees.
14. Insurance
Comprehensive travel insurance is strongly recommended.
15. Liabilities & Indemnity
PD acts solely as agent for the non-resident Principal and New Zealand suppliers. PD is not liable for loss, damage, delay, or events beyond its control. PD reserves the right to amend itineraries or substitute services when required. Payment of any deposit or final balance constitutes acceptance of these terms.
